Spiro Harrison & Nelson LLC filed an antitrust class action on behalf of direct purchasers of tires alleging that large tire manufacturers colluded to fix prices since as early as January 2020, causing purchasers to overpay for tires.

Eyeware Antitrust Class Action

Spiro Harrison & Nelson filed an antitrust class action on behalf of consumers against eyeware conglomerate EssilorLuxottica S.A. and affiliated entities alleging that they unlawfully monopolized the eyeware market in violation of federal antitrust law. The complaint alleges that EssilorLuxottica S.A. controls the manufacture, distribution, pricing and sale of the majority of eyewear purchased by consumers, although consumers typically believe they are purchasing eyeware from separate, independent brands.

Spiro Harrison & Nelson Successfully Represents Whistleblower in COVID Loan Fraud Case

In response to the immediate challenges posed by the COVID-19 pandemic in March 2020, Congress granted the federal Small Business Administration (SBA) the authority to administer emergency loans through the Paycheck Protection Program (PPP). These federally guaranteed loans were designed to assist eligible businesses in covering essential expenses such as payroll and rent during government-imposed shutdowns. Notably, these loans, including associated interest and fees, could potentially be forgiven.

Michelle Clerkin advocates for individuals and entities in complex disputes, including antitrust, consumer protection, and commercial litigation matters. She has extensive experience representing clients in antitrust matters involving price-fixing, unlawful monopolization, and other anticompetitive practices. Michelle has served on litigation teams in a variety of antitrust actions in federal courts across the country spanning the agricultural, financial, pharmaceutical, consumer product, and technology industries. She also has extensive class action experience and was appointed by federal courts to serve on Plaintiffs’ Steering Committees in In re Chicago Board Options Exchange Volatility Index Manipulation Antitrust Litigation (N.D. Ill.) and In re Juul Labs, Inc. Antitrust Litigation (N.D. Cal.). September 2022: Clergy sue to halt Florida abortion law, citing religious freedom

Here’s the latest on Spiro Harrison & Nelson LLC’s pro bono representation of 7 clergy members and their request last week for a temporary injunction on Florida’s stringent abortion law, prohibiting abortion after 15 weeks with no exception for rape or incest.

August 2022: Spiro Harrison & Nelson LLC files lawsuit seeking to overturn Florida’s controversial law, HB 5, which criminalizes abortion after 15 weeks and provides no exception for incest, rape, or trafficking.

A diverse array of seven Florida-based faith leaders today filed a lawsuit in Florida court in Miami-Dade County seeking to overturn Florida’s controversial law, HB 5 – which restricts abortion after 15 weeks and provides no exception for incest, rape, or trafficking. The plaintiffs – representing Reform Judaism, Buddhism, the Episcopal Church, the United Church of Christ, and the Unitarian Universalist Church – assert that HB 5 violates their constitutional rights of freedom of speech and free exercise of religion, the constitutional separation of Church and State, and the Florida Religious Freedom Restoration Act. They are being represented by Marci Hamilton, Professor of Practice in Political Science at the University of Pennsylvania and law and religion expert and attorneys Adlai Small, Danielle Moriber and David Harrison at Spiro Harrison & Nelson LLC; and Vivek Jayaram and Liz Austermuehle at Jayaram Law.

Spiro Harrison & Nelson LLC Partners Jason C. Spiro and Thomas M. Kenny win motion on behalf of client Suntuity Solar, LLC in a case against defendant, Empire Solar Group. Empire Solar group moved to dismiss Suntuity’s claims of fraud, defamation and tortious interference but was denied. The case will now proceed to discovery. Read more>>

An attorney for the firm, Fortinbras Asset Management, argued that his client’s work unwinding interest rate swaps for defendant Credit Suisse had made it eligible to receive a payout from the class action settlement, reached in 2016 in Manhattan federal court.

December 2020: Spiro Harrison & Nelson LLC Played Role in the Presidential Pardoning of Military Veterans

We are thrilled to have played a role in the pardoning of our client Paul Slough and his fellow decorated military veterans Evan Liberty, Dustin Heard, and Nick Slatten. Paul, Evan, Dustin, and Nick were charged with crimes related to a violent incident in Iraq during the height of the insurgency while defending government officials as state department contractors. After the initial prosecution was dismissed for “egregious” constitutional violations, the men were retried and convicted, sentenced to 12-15 years in prison, and in one case life imprisonment. As a result of this full pardon, these men will now be reunited with their families after six years in federal prison.
